GRANTS, N.M. — Over the past month, a Cibola County grand jury returned indictments against eleven defendants on 24 felony counts and six misdemeanors, with allegations ranging from first-degree criminal sexual penetration of a child under 13 to aggravated stalking, burglary, and drug possession. An indictment is only an allegation; all defendants are presumed innocent unless and until proven guilty in a court of law.

Martin Borthagarary has been indicted on the charges of two counts of Criminal Sexual Penetration in the First Degree child Under 13 (first degree felonies) which occurred on or between February 1, 2018 and January 31, 2025. One count of Criminal Sexual Penetration in the Second degree child age 13-18 (second degree felony) which occurred on or between April 7, 2025 and April 13, 2025. Four counts of Criminal Sexual Contact of a Minor child under 13 (second degree felony) on or Between August 1, 2021 and May 31, 2022 and August 10, 2019 and January 31, 2020. Four Counts of Abuse of a Child Does not result in Death or Great Bodily Harm (third degree felony) which occurred on or between August 9, 2020 and April 13, 2025, and December 25, 2024 and April 20, 2025 and April 1, 2023 and August 1, 2023. There was 3 victims involved on the indictments.

Johnny Sanchez-Delara has been indicted on the charges of Criminal Sexual Penetration (Third degree felony) which occurred on or about January 31, 2025.

Timothy Jaramillo has been indicted on the charges of Aggravated Burglary Commits Battery (second degree felony), Battery Against a Household Member (misdemeanor), Deprivation of the Property of a Household Member (misdemeanor), Making a Shooting Threat (misdemeanor), Use of Telephone to Terrify, Intimidate, Threaten, Harass, Annoy or Offend (misdemeanor).

Randy Haskin has been indicted on the charges of Aggravated Stalking Violation of Protection Order (fourth degree felony), Criminal Damage to Property over $1,000 (fourth degree felony), Violation of restraining order prohibited domestic violence (misdemeanor).

Tricia Patton has been indicted on the charges of Aggravated Assault Against a Household Member Deadly Weapon (fourth degree felony) and Aggravated Battery Against a Household Member No Great Bodily Harm (misdemeanor).

Herbert Lewis Welsch III has been indicted on the charges of Non-Residential Burglary (fourth degree felony), Possession of Burglary Tools (fourth degree felony), and Criminal Damage to Property over $1,000 (fourth degree felony).

Joel Rael has been indicted on the charge of Aggravated Indecent Exposure Victim is Less Than 18 Years Old (fourth degree felony).

Justin Dixon has been indicted on the charge of Possession of a Controlled Substance (fourth degree felony).

Shayna Swenke has been indicted on the charge of Embezzled of a Motor Vehicle (fourth degree felony).

Nolan Emerson has been indicted on the charge of Battery Upon a Health Care Worker (fourth degree felony).

Quintin Wengert has been indicted on the charge of Aggravated Stalking Violation of Protection Order (fourth degree felony).
