MILAN, NM – On August 2 at approximately 9:21 p.m. Milan Police Department officers responded to a domestic call. The female caller stated that her husband slapped her and was outside the residence. Dispatch told officers that the male had a possible warrant out for his arrest.
Officers arrived at the residence and made contact with a male outside. He was identified as Alessandro Rodriguez. Officers were informed by dispatch that Rodriguez did indeed have a valid warrant for his arrest. Officers then asked Rodriquez what had happened. Rodriguez said that he got into an argument with his wife. Rodriguez said that they were arguing, and she kept putting her hands in his face, so he pushed them out of the way. Officers escorted Rodriguez to his unit and placed him into handcuffs, they explained that he was not under arrest and was just detained due to the warrant for his arrest.
Officers then made contact with the wife and asked her what had happened. According to the report, she said the two were in an argument because Rodriguez’s mother was going to be coming to town. She said she does not like the pressure his mother puts on her, so she told Rodriguez she was going to be staying at a hotel while his mother was in town. She said they began arguing about it. According to the report, she said Rodrguez was holding their infant baby and she attempted to grab him, Rodriguez then pulled away from her with the child. Officers asked if that was all that happened, she said that Rodriguez then slapped her arm. Officers asked her to show them how Rodriguez had slapped her, and held out his arm for her to demonstrate.
She slapped the officer’s arm in an attempt to show how Rodriguez slapped her arm. According to the report, the slap was not how Rodriguez described it as pushing her arms out of the way. The report said it was a forceful slap. Upon examining her arm, officers noted a slight redness that could barely be seen on top of her forearm. Officers then went back to his unit and spoke to Rodriguez. They informed him he was going to be arresting Rodriguez for battery on a household member and his warrant out of NMSP. Porter also advised Rodriguez about his arrest. Rodriguez was then transported to Cibola County Correctional Center without incident.
