Domestic Dispute Leads to Arrest After Officer Kicked

GRANTS, N.M. — A domestic dispute escalated into an arrest in Grants, New Mexico, after a disturbance outside a home on Gold Avenue.

Grants Police Department responded to a call at approximately 8:30 p.m. on October 20 at 214 Gold Avenue. The initial report indicated a possible altercation between a couple, where a man stated his intoxicated girlfriend had locked herself inside a room.

According to the arrest report, on arrival, the officer encountered Isaiah Martinez, who reported that he and his girlfriend, identified as Ms. Kellena Garcia, had had an argument. Martinez added that during the confrontation, he broke Garcia's cellphone out of frustration, and she pushed him a few times.

Both parties recounted their versions of the incident, with Garcia admitting to having had a drink at a friend's place before returning home. The disagreement allegedly erupted over a text Garcia was sending to another female, whom Martinez might have been involved with.

The situation further complicated as both parents wanted custody of their two children. Without a court order in place, the officer couldn’t mandate custody decisions. The officer made several attempts to contact Garcia's mother for assistance, without success. It was initially agreed that each parent would leave with one child.

However, as Martinez and his family were departing, Garcia emerged from the residence, loudly confronting Martinez, leading to a disturbance. In the ensuing commotion, an attempt to arrest Garcia resulted in her allegedly kicking an officer. Following the incident, she was taken to Cibola General Hospital for a medical clearance before being transported to Core Civic Detention Center in Milan, New Mexico, where she was booked at approximately 9:50 p.m.

Garcia was later provided with her Arrest/Booking Report, Criminal Complaint, and Statement of Probable Cause.
