Constitutional Amendment 1

Text of the amendment

PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO TO PROVIDE THAT THE PUBLIC REGULATION COMMISSION CONSIST OF THREE MEMBERS APPOINTED BY THE GOVERNOR FROM A LIST OF PROFESSIONALLY QUALIFIED NOMINEES SUBMITTED TO THE GOVERNOR BY A NOMINATING COMMITTEE AS PROVIDED BY LAW AND THAT THE COMMISSION IS REQUIRED TO REGULATE PUBLIC UTILITIES AND MAY BE REQUIRED TO REGULATE OTHER PUBLIC SERVICE COMPANIES.

Understanding the amendment

The New Mexico Public Regulation Commission is currently made up of five people who serve various sections of the state. Currently all five members are elected to the PRC by the people they serve. This amendment would change the PRC from five members to three and they would no longer be elected by the people, instead they would be chosen by the governor after a commission recommends them to the governor.

For or against?

Voting FOR means the voter supports changing the PRC from five members to three and supports no longer electing the members.

Voting AGAINST means the voter does not support changing the PRC from five members to three and would rather elect the commission than have them appointed.

Text of the amendments

PROPOSING TO AMEND ARTICLE 20, SECTION 3 OF THE CONSTITUTION OF NEW MEXICO TO PERMIT THE ADJUSTMENT BY LAW OF TERMS OF NON-STATEWIDE ELECTED OFFICERS AND TO STANDARDIZE THE DATE AN OFFICER BEGINS TO SERVE.

Understanding the amendment

This amendment changes the constitution so that non-state office holders can have their elections held with other major offices. For an election to be changed for a particular office, the state legislature must prove why it would be important. In effect, if passed, the amendment would allow the legislature to change the dates of certain elections.

For or against?

Voting “For” this amendment would be a vote in support of allowing the legislature to change the dates of certain elections.

Voting “Against” this amendment would be a vote to deny the legislature the ability to change the dates of certain elections.
